Fan Fiction and Derivative Works
Practical guidance, not legal advice. What follows is operational clarity about how Firstory works with transformative and derivative works. We are not your lawyer. Copyright and fair use questions are legally complex and jurisdiction-dependent. If you have specific legal concerns about your work, consult a qualified attorney.
Firstory provides the writing tool. You are responsible for understanding the copyright status of your source material and for ensuring your use of Firstory complies with applicable laws. Firstory does not monitor, pre-screen, or adjudicate the copyright status of content you create on the platform. We do not compare your work against databases of protected works, and we do not make judgments about what constitutes fair use, fair dealing, or infringement in your jurisdiction.
If you publish on platforms like AO3, familiarize yourself with that platform's content policies and community norms. Platform policies around AI-assisted content and transformative works vary and evolve. For a more detailed discussion of how Firstory handles canon material, AI-assisted fanworks, and platform-specific considerations, visit our Fanfic Trust Center.
AI Output
AI suggestions, analysis results, and generated content are provided as writing assistance, not professional advice. You remain solely responsible for reviewing, editing, and approving all content before publication or distribution. We make no guarantees about the accuracy, quality, or suitability of AI-generated content.
Pricing
Some features may require payment. Firstory MCP Pro access is offered as a one-time purchase through Stripe-hosted checkout. Pricing for the Firstory application is communicated through the platform. All payments are processed by Stripe; we do not store full payment card details.
Availability
The service is provided "as is" and may change, degrade, or be discontinued. We strive for reliable service but do not guarantee uninterrupted access. The operator may suspend access for abuse, security risk, non-payment, or legal reasons.
Limitation of Liability
Firstory is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to data loss or service interruption.
Copyright Infringement (DMCA)
Firstory respects the intellectual property rights of others and expects users to do the same. If you believe that content hosted on or distributed through Firstory infringes your copyright, you may submit a notice using the procedure described below.
Takedown Notice
To submit a copyright infringement notice, send an email to kevin@firstory.app with the following information:
- Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
- Identification of the material you claim is infringing, including enough detail for us to locate it on the platform (e.g., URLs, story titles, or account references).
- Your contact information â name, email address, and physical address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Your physical or electronic signature.
Counter-Notice
If you believe material you posted was removed or access was disabled by mistake or misidentification, you may submit a counter-notice to kevin@firstory.app. Your counter-notice must include: identification of the material removed, your contact information, a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification, a statement consenting to the jurisdiction of the courts in your residential district (or the jurisdiction specified in the Governing Law section of these terms if you are outside the United States), and your physical or electronic signature.
Repeat Infringer Policy
Firstory will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been the subject of multiple valid takedown notices or who has otherwise demonstrated a pattern of infringing activity.
Data Retention and Deletion
Active Accounts
While your account is active, Firstory retains your story content, character profiles, premises, AI interaction history, account information, and usage data. This data is retained to provide the service â your stories, your workspace, and your writing history remain available when you log in.
Account Deletion
When you request deletion of your account, your stories, characters, premises, AI interaction history, and all associated personal data are permanently and irreversibly deleted from our active systems. Deletion typically completes within 30 days of your request. You may request deletion by contacting kevin@firstory.app.
Backup Retention
System backups may retain residual copies of deleted data for up to 90 days before being cycled out of backup rotation. Backups are encrypted and inaccessible during normal operations; they exist solely for disaster recovery.
Legal and Compliance Retention
Certain data may be retained beyond the standard deletion window where required by applicable law, to comply with legal obligations, to resolve disputes, or to enforce our agreements. This includes, for example, billing records required for tax purposes or data preserved in response to a valid legal request.
Governing Law
Note: This clause requires legal verification. The governing law and jurisdiction stated below represents the operator's current understanding and should be confirmed with qualified legal counsel. It may be updated without notice as the corporate structure and operational footprint evolve.
These Terms of Service and any disputes arising from or relating to your use of Firstory shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law principles. However, if Firstory incorporates or establishes a principal place of business in the United States, the governing law shall be the laws of the State of Delaware, without regard to its conflict of law principles.
Dispute Resolution
We believe most disputes can be resolved through direct, good-faith conversation.
Step 1: Informal Resolution
Before pursuing any formal action, you agree to contact us at kevin@firstory.app and attempt to resolve the dispute informally. We will make a good-faith effort to address your concern within 30 days.
Step 2: Mediation or Arbitration
If informal resolution does not succeed, either party may propose mediation or binding arbitration. Both parties must mutually agree to the mediator, arbitrator, and forum. The costs of mediation or arbitration shall be shared equally unless the arbitrator determines otherwise.
Step 3: Courts
If mediation and arbitration are unsuccessful or not mutually agreed upon, disputes may be resolved in the courts of the jurisdiction specified in the Governing Law section above. Both parties submit to the personal jurisdiction of those courts. You agree that any claim must be brought individually and not as part of any class or representative action.
Changes to Terms
We may update these terms from time to time. Material changes will be reflected on this page. Continued use of the service after changes constitutes acceptance of the modified terms.
